Vacation Home Rental Agreement Terms & Conditions

This Vacation Home Rental Agreement (“Agreement”) is a binding contract between you (“Guest” or “Occupant”) and Pacific Sunset Group (“PSG”). By booking, paying for, or occupying the rental property (“Premises”), you agree to comply with the terms below. Please ensure every adult in your party has read this Agreement.

1. Rental Terms

• Eligibility: All adult Guests must be at least 28 years old, unless traveling as part of a family with children.

• Responsible Guest: At least one adult will be designated as the responsible party for the booking. Valid government-issued ID must be provided upon request.

2. Payment Terms

• Holding Fee: A non-refundable $150 holding fee is due at the time of booking.

• Payment Schedule:

o 30% mid-payment (rounded to the nearest $100) due 30 days after booking.

o Final balance due 60 days before check-in.

• Late Bookings: For reservations made within 60 days of arrival, the full balance is due at booking (online reservations) or within 7 days (bookings made directly with PSG personnel).

3. Payment Options

• Online: Through PSG’s secure Guest Portal (E-check or credit card).

• By Phone: Call 619-275-2011.

• Credit card payments incur a 3.2% processing fee (deducted from your deposit or added to your balance). Debit cards are processed as credit cards. E-checks have no fee.

4. What’s Included

• Supplies: Linens, towels, beach towels, cookware, dishes, and starter supplies (toilet paper, paper towels, dish soap, hand soap, laundry and dishwasher detergent).

• Beach Towels: Do not use bath towels outdoors. Please shake out all sand and launder beach towels before departure.

5. Property Access

• Check-In / Check-Out: Times will be provided in your Welcome Letter.

• Entry: Keyless entry code and garage fobs (if applicable) will be provided once final payment is received.

• Lost Remotes: A fee of $150 per missing garage remote will be charged.

6. Utilities & Wi-Fi

Utilities and Wi-Fi are included in your rental. Network details will be provided in your Welcome Letter.

7. Property Condition & Guest Responsibilities

• Arrival Inspection: Guests must report any issues, damage, or malfunctions upon arrival.

• Care of Property: Keep the Premises clean and return furnishings to their original positions.

• Damages: Guests are responsible for any damage beyond normal wear and tear.

• Drains: Only toilet paper may be flushed. Guests pay for clogs caused by wipes, paper towels, or feminine products.

8. Security Deposit & Damage Protection

• Security Deposit: Held in PSG’s Trust Account and may be applied toward damages or violations. Balance returned after inspection.

• Vacation Rental Damage Protection (Optional): Covers up to $3,000 in accidental damage if purchased prior to final payment. Full details: www.vacationrentalinsurance.com/g20vrd.

9. Repairs & Right of Entry

PSG may enter the Premises for repairs, maintenance, emergencies, or to verify compliance with this Agreement.

10. Rules & Restrictions

• No Smoking: Smoking inside is prohibited. Violations incur a $150 penalty plus cleaning fees. Outdoor smoking is permitted only with safe disposal of butts.

• No Pets: Unauthorized pets result in eviction and forfeiture of deposits.

• No Boards or Bikes Indoors: Surfboards, bikes, skateboards, etc. are not allowed inside or on decks.

• No Subletting: Subleasing or assignment of this rental is prohibited.

11. Disturbances & Conduct

• Noise & Behavior: Guests must not disturb neighbors or use the Premises unlawfully.

• Parties: Unauthorized parties or events are strictly prohibited.

• Fines: Neighbor complaints or police involvement will result in a $100 fine per occurrence and possible eviction.

• Zero-Tolerance Policy: No illegal drugs or paraphernalia are permitted.

12. Cancellations & Refunds

• Standard Policy: All monies paid are non-refundable unless the property is re-rented for the same dates, in which case refunds will be issued proportionally.

• Refundable Fees: Security deposits, cleaning fees, and transient occupancy tax (TOT) are always refunded.

• Travel Insurance: PSG strongly recommends CSA Travel Insurance for protection against cancellations, emergencies, and unexpected events. Insurance must be purchased before final payment.

13. Holding Over

Unauthorized late departure is billed at 150% of the daily rate, plus damages or relocation costs for incoming Guests. Late check-outs are billed at 50% of this rate.

14. Departure Obligations

At check-out, Guests must:

1. Return key fob remotes.

2. Vacate all persons and vehicles.

3. Leave the Premises in good condition (normal wear & tear excepted).

4. Start dishwasher with used dishes.

5. Start one load of laundry (linens/towels).

6. Remove trash to outside receptacles.

7. Ensure windows/doors are locked, lights/appliances are off.

15. Liability & Insurance

• Personal Property: Guests’ belongings and vehicles are not insured by PSG, the Owner, or HOA.

• Guest Insurance: Guests are encouraged to carry renters’ or travel insurance.

• Indemnification: Guest agrees to indemnify and hold harmless PSG and the Owner from claims, damages, or injuries except those caused by Owner/Manager negligence.

16. Legal Notices

• Megan’s Law Disclosure: Information on registered sex offenders is available at www.meganslaw.ca.gov.

• Mediation: Any dispute will first be submitted to mediation before legal proceedings.

• Governing Law: This Agreement is governed by California law. Venue lies in the county where the Premises are located.

• Entire Agreement: This document represents the entire agreement between Guest and PSG.

• Please provide the full names, ages, and occupations of all Guests in your Guest Portal.
